Probate is the culmination of an individual’s estate planning measures. Ohio Probate is the process of of administering an individual’s estate after they have died. Probate only applies to a decedent’s estate if they have died intestate (without a will) or testate (with a will). If the decedent has died intestate, then the Ohio probate court will administer the estate in accordance to the statutes of the state. If the decedent has died testate, then the probate court will administer the estate in accordance with the will and the statutes of the state. If you only have trust documents that govern your estate, your estate will not have to go through probate.
